These Terms of Service ("Terms") govern your access to and use of services provided by WeGen LLC ("WeGen," "we," "us," or "our"), including our website, conformance review engine, reports, and related services (collectively, the "Services").

By using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

Services overview

WeGen provides web-based conformance review services that analyze publicly accessible website content against industry-specific regulatory frameworks. Our engine identifies potential conformance gaps and produces informational reports.

Important: WeGen is a conformance review tool. Our reports are informational only and do not constitute legal, regulatory, or professional advice. We do not provide legal opinions, certifications, or attestations. Organizations should consult qualified legal counsel for specific regulatory questions.

Account and access

  • You must provide accurate information when requesting services
  • You are responsible for maintaining the confidentiality of any account credentials
  • You may not share report access with unauthorized parties
  • We reserve the right to suspend or terminate access for violations of these Terms

Permitted use

You may use our Services for lawful business purposes, including:

  • Reviewing your own website's conformance posture
  • Internal conformance assessment and remediation planning
  • Sharing reports with your authorized team members and advisors

You may not:

  • Use our reports to make public claims about a competitor's conformance status
  • Redistribute, resell, or sublicense our reports or data without written consent
  • Use the Services for any unlawful purpose or to harass, defame, or harm others
  • Attempt to reverse-engineer, decompile, or extract our review methodology, check catalog, or scoring algorithms
  • Submit requests to scan websites you do not own or have authorization to evaluate

Intellectual property

All content, methodology, check frameworks, scoring algorithms, and software comprising the Services are the intellectual property of WeGen LLC. Our conformance check catalog, industry module architecture, and review engine are proprietary.

Reports generated for you are licensed for your internal business use. You retain ownership of your website content; we retain ownership of the analysis methodology and presentation format.

Data handling

We scan only publicly accessible web pages. We do not access internal systems, databases, or password-protected areas. Our data practices are detailed in our Privacy Policy and Trust & Security page.

Scan results are stored securely and shared only with the authorized requesting client. We do not sell, share, or monetize scan data.

Payment terms

  • Pricing is as quoted at the time of service engagement
  • Payment is due upon receipt of invoice unless otherwise agreed in writing
  • All fees are non-refundable once a scan has been initiated and results delivered
  • We reserve the right to update pricing with 30 days' written notice

Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:

  • Our conformance checks are exhaustive of all possible regulatory requirements
  • Results will be error-free or uninterrupted
  • Using our Services will prevent regulatory action, fines, or legal proceedings

Regulatory landscapes change frequently. Our checks reflect requirements as of the date of the scan. Laws and regulations may have changed since the most recent update to our engine.

Limitation of liability

To the maximum extent permitted by applicable law, WeGen LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Services, including but not limited to: regulatory fines, legal fees, lost profits, data loss, or business interruption.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount paid by you to WeGen for the specific service giving rise to the claim during the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless WeGen LLC, its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

Termination

Either party may terminate the service relationship at any time with written notice. Upon termination:

  • Your access to reports and dashboards will be revoked
  • We will retain your data per our data retention policy (see Privacy Policy)
  • You may request deletion of your data within 30 days of termination

Governing law

These Terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in New Hampshire.

Changes to these terms

We may update these Terms from time to time. Material changes will be communicated to active clients via email. Continued use of the Services after changes constitutes acceptance of the updated Terms.
